If you do not agree to these terms, do not subscribe.
ARTICLE 1: DEFINITIONS
1.1 "365 Booking Guarantee" or "Guarantee" means the conditional money-back guarantee program offered by Estaviz to eligible Subscribers who have paid for a full year of service, as set forth in these Terms.
1.2 "Qualifying Subscription" means any paid Estaviz subscription (Personal, Pro, or Enterprise) where the Subscriber has either: (a) purchased an annual plan paid in full at the time of subscription; or (b) maintained an active monthly subscription with successful payments for twelve (12) consecutive months without interruption. Both payment methods qualify equally for this Guarantee.
1.3 "Booking" means a confirmed reservation of the Subscriber's property by a third-party guest, as further defined in Article 4 of these Terms.
1.4 "Booking Signal" means any tracked user interaction, engagement metric, or data point collected by the Platform that indicates potential or confirmed booking activity, as described in Article 5.
1.5 "Confidence Score" means the aggregate probability percentage assigned to a Subscriber's account based on accumulated Booking Signals, calculated according to the methodology described in Article 5.
1.6 "Effective Date" means: (a) for annual subscriptions, the date on which the annual payment is successfully processed and confirmed; or (b) for monthly subscriptions, the date of the twelfth (12th) consecutive successful monthly payment.
1.7 "Eligible Property" means a property that meets all requirements set forth in Article 3, including active QR code deployment.
1.8 "Guarantee Period" means the three hundred sixty-five (365) consecutive calendar day period commencing on the Effective Date.
1.9 "Platform" means the Estaviz software application, website, APIs, and all related services and infrastructure.
1.10 "Paid Subscription Plan" means any Estaviz subscription tier (Personal, Pro, or Enterprise) with either annual billing paid in full, or monthly billing maintained for twelve (12) consecutive months.
1.11 "QR Code" means the unique quick response code generated by the Platform for each Eligible Property, used to track guest engagement.
1.12 "Refund" means the monetary reimbursement issued to eligible Subscribers pursuant to Article 7.
1.13 "Subscriber" means the individual or legal entity that has entered into a Qualifying Subscription agreement with Estaviz as defined in Section 1.2.
1.14 "Subscription Fee" means: (a) for annual subscriptions, the total amount paid at the time of purchase; or (b) for monthly subscriptions, the sum of all twelve (12) consecutive monthly payments made during the Qualifying Period. Excludes any applicable taxes, fees, add-ons, or promotional credits.
ARTICLE 2: ELIGIBILITY REQUIREMENTS
2.1 Subscription Requirement. The Guarantee is available to Subscribers who meet one of the following criteria: (a) purchase any annual subscription plan (Personal, Pro, or Enterprise) with full payment at the time of subscription; or (b) maintain any monthly subscription plan (Personal, Pro, or Enterprise) with successful, uninterrupted payments for twelve (12) consecutive months. ALL PAID SUBSCRIPTION TIERS QUALIFY FOR THE GUARANTEE WHEN THE FULL-YEAR PAYMENT REQUIREMENT IS MET.
2.2 New Subscriptions and Qualifying Events. For annual subscriptions, the Guarantee Period commences on the date of the annual payment. For monthly subscriptions, the Guarantee Period commences on the date of the twelfth (12th) consecutive successful monthly payment. Upgrades between plan tiers do not reset the Guarantee Period if the Subscriber maintains continuous payment history.
2.3 Account Standing. To maintain eligibility, the Subscriber must:
- Maintain an account in good standing throughout the Guarantee Period;
- Not have any pending disputes, chargebacks, or payment reversals;
- Not be in violation of the Estaviz Terms of Service or Acceptable Use Policy;
- Not have been previously terminated or suspended for any reason;
- Provide accurate and complete account information.
2.4 Geographic Eligibility. The Guarantee is available to Subscribers in all jurisdictions where Estaviz operates, subject to applicable local laws and regulations. Certain jurisdictions may have additional requirements or restrictions.
2.5 Entity Eligibility. Both individual and business entity Subscribers are eligible, provided all other requirements are met. For business entities, the authorized representative must have the legal authority to bind the entity to these Terms.
2.6 Single Guarantee Per Subscription. Each Qualifying Subscription is eligible for one (1) Guarantee claim only. Subsequent subscription periods require a new Guarantee eligibility determination.
2.7 Serial Claimant Limitations. To prevent abuse of the Guarantee program:
- No individual, entity, or affiliated group of entities may submit more than two (2) Guarantee claims in any five (5) year period;
- A minimum cooling-off period of six (6) months must elapse between the processing of a Guarantee Refund and the commencement of a new Guarantee Period;
- Second and subsequent claims are subject to enhanced review, including manual verification of all eligibility requirements regardless of Confidence Score;
- For purposes of this Section, "affiliated group" means entities under common ownership, control, or management, or entities where a principal of one entity is also a principal of another.
ARTICLE 3: PROPERTY REQUIREMENTS
3.1 Minimum Property Requirement. The Subscriber must have at least one (1) Eligible Property registered on the Platform throughout the Guarantee Period.
3.2 QR Code Deployment. Each Eligible Property must have:
- An active, unique QR Code generated through the Platform;
- The QR Code physically deployed at the property location in a manner accessible to guests;
- The QR Code maintained in scannable condition throughout the Guarantee Period;
- The QR Code linked to an active, complete property profile on the Platform.
3.3 Property Profile Completeness. Each Eligible Property must maintain a property profile that includes, at minimum:
- Property name and address;
- Property type and description;
- At least one (1) room or space configuration;
- Contact information for guest inquiries;
- Active booking link or direct booking rebate (if applicable).
3.4 Property Availability. The property must be genuinely available for rental to third-party guests during the Guarantee Period. Properties used exclusively for personal use, not listed on any booking platform, or otherwise unavailable for guest reservations do not qualify.
3.5 Property Modifications. The Subscriber may add, remove, or modify properties during the Guarantee Period, provided at least one (1) Eligible Property remains active at all times. Removal of all Eligible Properties will void the Guarantee.
3.6 Multiple Properties. For Subscribers with multiple properties, a Booking on any single Eligible Property satisfies the Guarantee requirement. The Guarantee does not require Bookings on all properties.
3.7 Property Verification. The Company reserves the right, at any time during or after the Guarantee Period, to verify that an Eligible Property:
- Exists at the address provided and is a genuine short-term rental property;
- Has been available for rental by third-party guests during the Guarantee Period;
- Has a QR code deployed in a manner accessible to guests;
- Has an accurate and truthful property profile on the Platform.
Verification may include, but is not limited to: requests for photographic evidence of QR code deployment, screenshots of active third-party listings, cross-referencing public listing data, or on-site inspection. Failure to cooperate with a reasonable verification request within fourteen (14) days may result in claim denial or Guarantee forfeiture.
ARTICLE 4: DEFINITION OF BOOKING
4.1 Qualifying Booking. For purposes of this Guarantee, a "Booking" is defined as any of the following:
- (a) Confirmed Reservation: A confirmed reservation of the Subscriber's property by a third-party guest through any booking platform, direct booking system, or other reservation method;
- (b) Direct booking rebate: a guest completes a booking through an Estaviz direct booking flow with an owner-enabled rebate;
- (c) Platform Webhook Confirmation: Receipt of a confirmed booking notification through an integrated booking platform webhook;
- (d) High-Confidence Signal Threshold: Accumulation of Booking Signals resulting in a Confidence Score of one hundred percent (100%), as calculated by the Platform's tracking system.
4.2 Booking Attribution. A Booking must be reasonably attributable to the Subscriber's use of the Platform. Bookings must originate from or be connected to engagement with the Platform, including but not limited to QR code scans, property portal visits, direct booking rebate views, or booking link clicks.
4.3 Timing. The Booking must occur within the Guarantee Period. Bookings made before the Effective Date or after the expiration of the Guarantee Period do not satisfy the Guarantee requirement.
4.4 Guest Requirements. The booking guest must be:
- A bona fide third party with no familial, employment, or business relationship with the Subscriber;
- A real person or legitimate entity (not a bot, automated system, or fictitious person);
- Engaged in a genuine arm's length transaction.
4.5 Exclusions. The following do not constitute qualifying Bookings:
- Self-bookings by the Subscriber, employees, or family members;
- Test bookings or reservations immediately cancelled;
- Bookings obtained through fraudulent, deceptive, or manipulative means;
- Bookings for properties not registered as Eligible Properties on the Platform;
- Complimentary stays or zero-value reservations;
- Bookings that are subsequently charged back, refunded, or disputed.
ARTICLE 5: TRACKING AND DETECTION METHODOLOGY
5.1 Signal-Based Tracking. The Platform employs a proprietary signal-based tracking system to detect booking activity. This system analyzes multiple engagement signals to determine booking probability without requiring explicit confirmation from guests.
5.2 Signal Categories. Booking Signals are categorized into four (4) confidence tiers:
(a) Confirmed Signals (100% Confidence):
- direct booking confirmation with merchant confirmation
- Booking platform webhook confirmation
- Direct booking system confirmation
- Explicit guest confirmation through Platform interface
(b) High-Confidence Signals (60-95% Confidence):
- Extended booking session (>3 minutes on booking flow)
- direct booking started to clipboard
- Multiple booking intent signals in single session
- Return visit with booking page access
- Booking link click followed by extended external session
(c) Medium-Confidence Signals (20-50% Confidence):
- Booking link click
- Direct booking rebate viewed for >30 seconds
- QR scan followed by direct booking rebate view
- Multiple page views including booking information
- Contact information accessed
(d) Supporting Signals (5-30% Confidence):
- QR code scan
- Extended property page view (>2 minutes)
- Return visit to property
- Multiple room/amenity views
- Guide or instruction access
5.3 Confidence Score Calculation. The Platform calculates a cumulative Confidence Score based on the weighted aggregation of all detected signals. The specific algorithm and weighting factors are proprietary and subject to modification at the Company's discretion.
5.4 Threshold for Booking Determination. A Confidence Score of one hundred percent (100%) constitutes a confirmed Booking for purposes of the Guarantee. Scores below 100% represent probability assessments and do not confirm a Booking.
5.5 Dashboard Transparency. Subscribers may view their current Confidence Score, detected signals, and tracking history through the Platform dashboard. This information is provided for transparency purposes only and does not constitute a guarantee of accuracy.
5.6 Signal Decay. Certain signals may be subject to time-based decay or depreciation in the Confidence Score calculation. The Company reserves the right to modify decay rates and signal valuations.
5.7 Technical Limitations. The Subscriber acknowledges that tracking systems may have technical limitations including but not limited to:
- Browser privacy settings that block tracking;
- Ad blockers or privacy extensions;
- VPN or proxy usage;
- Device or browser incompatibilities;
- Network interruptions or failures;
- Third-party platform limitations.
5.8 No Guarantee of Detection. The Company does not guarantee detection of all bookings. Bookings that occur entirely outside the Platform's tracking capabilities may not be detected or credited to the Subscriber's Confidence Score.
ARTICLE 6: GUARANTEE PERIOD
6.1 Commencement. The Guarantee Period commences at 12:00:00 AM Coordinated Universal Time (UTC) on the day following the Effective Date as defined in Section 1.6.
6.2 Duration. The Guarantee Period continues for exactly three hundred sixty-five (365) consecutive calendar days from commencement.
6.3 Expiration. The Guarantee Period expires at 11:59:59 PM UTC on the final day, regardless of the Subscriber's time zone.
6.4 No Extensions. The Guarantee Period is not subject to extension, tolling, or suspension for any reason, including but not limited to:
- Service interruptions or Platform downtime;
- Subscriber account suspension or temporary deactivation;
- Property availability issues;
- Force majeure events;
- Subscriber request.
6.5 Time Zone. All times referenced in these Terms are in Coordinated Universal Time (UTC) unless otherwise specified.
ARTICLE 7: REFUND TERMS AND CLAIM PROCESS

- No qualifying Booking occurred during the Guarantee Period;
- The Confidence Score remained below one hundred percent (100%) throughout the Guarantee Period;
- The Subscriber submits a valid claim pursuant to Section 7.3.
7.2 Refund Amount. The Refund amount shall be equal to one hundred percent (100%) of the Subscription Fee actually paid by the Subscriber, excluding:
- Any applicable taxes, duties, or government-imposed fees;
- Payment processing fees or surcharges;
- Add-on services or features purchased separately;
- Credits, promotional discounts, or direct booking rebate values applied to the subscription;
- Amounts previously refunded or credited.
7.3 Claim Submission. To initiate a Refund claim, the Subscriber must:

- (c) Submit the claim no later than thirty (30) days following expiration of the Guarantee Period;
- (d) Include the Subscriber's account email, subscription ID, and a statement confirming no Booking was received;
- (e) Provide any additional documentation reasonably requested by the Company.
7.4 Claim Window. Claims must be submitted within the thirty (30) day window following Guarantee Period expiration. CLAIMS SUBMITTED AFTER THIS WINDOW WILL BE AUTOMATICALLY DENIED WITHOUT EXCEPTION.
7.5 Claim Review. Upon receipt of a valid claim, the Company will:
- (a) Verify the Subscriber's eligibility and compliance with these Terms;
- (b) Review the Subscriber's tracking data and Confidence Score history;
- (c) Conduct any additional investigation deemed necessary;
- (d) Render a decision within fourteen (14) business days of claim submission.
7.6 Tiered Claim Review. Claims are processed according to the following framework based on the Subscriber's final Confidence Score:
| guaranteeTermsDoc.art7.table_score | Review Process | Expected Timeline |
|---|---|---|
| Below 50% | Automatic Approval | 5–7 business days |
| 50% – 80% | Manual Review | Up to 14 business days |
| Above 80% | Presumptive Denial with Review | Up to 14 business days |
| 100% (Confirmed Booking) | Automatic Denial | Immediate |

7.8 Manual Review. Claims from Subscribers with a final Confidence Score between fifty percent (50%) and eighty percent (80%), or claims flagged for potential issues, will undergo manual review by the Company's guarantee team.
7.9 Presumptive Denial. Claims from Subscribers with a final Confidence Score above eighty percent (80%) are subject to a rebuttable presumption that a qualifying Booking occurred. The burden shifts to the Subscriber to demonstrate, with supporting evidence, that no qualifying Booking took place. The Company will review such claims and provide the Subscriber an opportunity to submit evidence before rendering a final decision.
7.10 Refund Processing. Approved Refunds will be processed within five (5) to seven (7) business days following approval. Refunds will be issued to the original payment method used for the Subscription Fee. If the original payment method is unavailable, the Company will work with the Subscriber to arrange an alternative refund method.
7.11 Claim Denial. The Company may deny a claim for any of the following reasons:
- Failure to meet eligibility requirements;
- Detection of a qualifying Booking during the Guarantee Period;
- Confidence Score reached 100% at any point during the Guarantee Period;
- Violation of these Terms or the Estaviz Terms of Service;
- Fraudulent, deceptive, or manipulative conduct;
- Claim submitted outside the claim window;
- Incomplete or inaccurate claim information;
- Failure to maintain an Eligible Property;
- Failure to cooperate with property verification requests pursuant to Section 3.7;
- Exceeding the serial claimant limits set forth in Section 2.7;
- Confidence Score exceeded eighty percent (80%) and Subscriber failed to rebut the presumption under Section 7.9.
7.12 Appeal Process. Subscribers may appeal a denied claim within fifteen (15) days of denial by submitting a written appeal with supporting documentation. Appeals are reviewed by a senior member of the guarantee team, and the decision on appeal is final and binding.
ARTICLE 8: EXCLUSIONS AND LIMITATIONS
8.1 Subscription Type Exclusion. Trial subscriptions and free plans do not qualify for the Guarantee. Monthly subscriptions that have not completed twelve (12) consecutive successful payments do not qualify until the payment requirement is met. ALL PAID SUBSCRIPTION TIERS (STARTER, PRO, ENTERPRISE) QUALIFY ONCE THE FULL-YEAR PAYMENT REQUIREMENT IS SATISFIED.

- Collusion with third parties to create fraudulent bookings;
- Intentional blocking or interference with tracking systems;
- Misrepresentation of property information or booking status;

8.6 Force Majeure. The Company shall not be liable for failure to perform any obligation under this Guarantee due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, government actions, pandemic, infrastructure failures, or third-party service disruptions.

- The Company reserves the right to apply enhanced scrutiny to subsequent Guarantee claims from the same Subscriber or affiliated entities.
9.4 No Partial Refunds. The Guarantee provides for a full Refund of the Subscription Fee or no Refund. Partial refunds are not available under the Guarantee program. This provision does not affect any separate refund rights the Subscriber may have under applicable consumer protection laws or the Estaviz Terms of Service.
ARTICLE 10: DATA COLLECTION AND PRIVACY
10.1 Consent to Tracking. By participating in the Guarantee program, the Subscriber consents to the collection, processing, and analysis of engagement data as described in Article 5.
